Qui Tam Class Actions
Qui tam is taken from the Latin phrase "Qui tam pro domino rege quam pro si ipso in hac parte sequitur," which means "Who sues on behalf of the King, as well as for Himself." The law of qui tam is based upon the False Claims Act.
The qui tam law was created to incentivize individuals to fight fraud and corruption against the government by acting as a whistleblower (against companies that are defrauding governmental entities).
This means that via qui tam lawsuits, whistleblowers may recover the government's losses on the government's behalf against the individuals and/or entities that are defrauding the government.
Whistleblowers who file successful claims against companies or persons who are defrauding the government are awarded between 15 percent and 25 percent of the recovery if the government intervenes; up to 30 percent if the government does not intervene and they pursue the case alone or with their lawyer.

What Is A Class Action?
A class action lawsuit allows a large group of people with similar grievances to unite in one lawsuit against a company or individual. Instead of filing multiple individual lawsuits, a class action enables efficiency and collective justice.
In state and federal courts, these cases are governed by rules like Federal Rule of Civil Procedure 23 and 28 U.S.C.A. § 1332(d). Federal courts have jurisdiction if:
- The dispute exceeds $5 million.
- Class members and defendants are from different states or countries.
Class action suits often address consumer fraud, unfair business practices, false advertising, identity theft, or defective products. Class action complaints seek injunctive relief, financial compensation, and justice for those harmed by deceptive business practices.
To start, a class representative (lead plaintiff) files the complaint on behalf of the group. The court then decides if the case meets "CANT" criteria:
- Commonality – Claims must share legal or factual issues.
- Adequacy – The lead plaintiff must fairly represent class interests.
- Numerosity – The class must be large enough that individual lawsuits are impractical.
- Typicality – The lead plaintiff's claims must reflect those of the entire group.
The court may also require proof that class actions are more effective than individual claims. The firm handling the case must demonstrate extensive experience and the resources to manage complex cases.
Once a class is certified, class members receive notices explaining their rights, including the option to opt out if they wish to file individual claims. If a settlement is proposed, all class members are notified.
